In the past three years Chambers have been involved in 35 cases involving declarations of parentage arising from errors made by fertility cases following on from the leading case of HFEA (A and others) (Legal Parenthood) [2016] 1WLR 135. These cases require a knowledge of the interface between fertility law and family law and 1GC Family Law has an unrivalled record of representing families in this new and developing area.
We have many Members of Chambers within the field of surrogacy who have appeared in cases which have developed the law and guidance in this area over the past five years including Re H (Surrogacy Breakdown) [2017] EWCA 1798 and Re M (Surrogacy) [2017] EWCA Civ 228. Deirdre Fottrell KC and Tom Wilson are advising the Jersey Law Commission on proposals to reform the law of surrogacy in that jurisdiction.
Members of 1GC Family Law act in cases involving atypical and modern families structures, for example in the case Re G (a child) [2018] EWCA Civ 308, in which the Court upheld a decision to allow the parents of a sperm donor father to have contact with his child.
