A decision concerning a Declaration of Parentage has been handed down by Mrs Justice Theis. The applicant sought a DoP having traced her birth father, first through ancestry websites and then with the assistance of a genealogist. The applicant attempted to contact the respondent without success. The respondent initially agreed to undertake DNA testing, then changed his mind. The application was issued and the Court directed that the respondent provide a DNA sample; the respondent refused. The Court was satisfied that as a result of the evidence provided by the applicant, together with the respondent’s lack of opposition to the making of the order and his refusal to provide a DNA sample, the applicant had proved to the Court’s satisfaction that the respondent was her father and made the order sought.
