Andrew Bagchi KC and Helen Jefferson, instructed by Hall Brown Family Law, and Richard Jones, instructed by Freemans acted for the respondent mother and the respondent children by their Children’s Guardian respectively in the Court of Appeal before Lord Justice Peter Jackson and Lord Justice Baker.

The case, T (Children: Non-Disclosure), Re [2024] EWCA Civ 241 involved two children, aged 8 and 12 whose parent’s had separated in 2021. The Court of Appeal made a decision relating to the approach courts should take when one party seeks to withhold information from another party. The court reviewed the law on disclosure and the need for a fair format when a judge is called upon to decide whether certain information should not be provided to another party.
