Deirdre Fottrell QC and Marlene Cayoun acted in the important case of Re K (Forced Marriage: Passport Order) in the Court of Appeal.
Deirdre and Marlene represented the Appellant, a woman in her thirties who had been the unwilling subject of a forced marriage protection order which included a passport order, the effect of which was to severely restrict her ability to travel.
The Court of Appeal agreed with Deirdre and Marlene’s submissions that such orders should only be made in “exceptional circumstances” and went on to give detailed guidance about the Family Court’s approach to Forced Marriage Protection Orders and to restrictions on travel of adult parties. This important judgment will serve as the ‘route map’ for all Forced Marriage Protection Order decisions in the future.
