In the Matter of the Human Fertilisation and Embryology Act 2008 (Case K) [2017] EWHC 50 (Fam)

This was another case in which the President made a declaration of parentage in circumstances where a fertility clinic had made administrative errors in the taking and recording of consent to parenthood. Unlike any other HFEA case, however, the local Registrar refused to register the father as the children's parent on their birth certificates. Deirdre Fottrell QC and Thomas Wilson were also successful on behalf of the father in a claim for judicial review of the Registrar's decision. In what is believed to be the first judicial review of its kind, the President made an order that the original registration be quashed and the father registered on the birth certificates.
