Deirdre Fottrell QC, Andrew Norton QC and Marlene Cayoun acted in the Hague Convention case of A v B [2015] EWHC 1562 in which Mrs Justice Pauffley found that a child conceived in Germany by natural means within an informal surrogacy agreement who resided there for several months had never been habitually resident in Germany.
The Applicant Mother was found to have consented to the child’s removal so that he could be raised in England by the Respondent Father and his wife. The case will have significant implications for issues of Habitual Residence in surrogacy and abduction cases.
