A significant decision concerning parental orders and the scope of section 54(3) HFEA 2008 has been handed down by Mrs Justice Theis . For the first time, the court made a parental order in respect of a person who is now an adult. The court undertook a detailed analysis of the case law, the Article 8 rights engaged and the serious and lifelong legal consequences for all concerned if the order was not made. There was an acknowledgment that there may well be other families in a similar situation who need to urgently consider their position and any consequences that may flow.
