Re CX (A child)(Reporting restrictions order: National security) [2026] EWHC 994

Louise MacLynn KC, Andrew Bagchi KC and Marlene Cayoun appeared in this case concerning the use of the inherent jurisdiction to make orders for reporting restrictions and disclosure in the context of national security considerations. The Secretary of State for Defence intervened and the Court adopted a closed material process.

Mr Justice Garrido determined that certain aspects of private law children proceedings could be the subject of disclosure and publication, taking into account arguments about the risks to national security arising from a journalist’s assertion that the Father was a member of the UK Security Forces and concerns related to the family’s safety and privacy on the one hand, and the importance of the principle of open justice on the other. Louise MacLynn KC acted as the Special Advocate in the closed material process. Andrew Bagchi KC and Marlene Cayoun acted for the Father.
