PS v BP [2018] EWHC 1987 (Fam)

Luke Eaton appeared on behalf of the successful appellant Father in a case that provides important informal guidance where the Court is considering preventing cross-examination of an alleged victim of domestic abuse by an alleged perpetrator who acts in person. In this case Hayden J provides a ‘forensic life boat’ for Judges (and lawyers) who are confronted with this difficult situation. The Court agreed that the first-instance hearing fell short of what fairness demands and so the appeal was allowed and a rehearing directed.
