Marlene Cayoun represented the Wife in the case of Kaur v Randhawa [2015] EWHC 1592 in which Mr Justice Mostyn found that a Husband’s brother had dishonestly sought to keep the proceeds of a family home out of the Wife’s hands.
The Wife successfully argued that the Husband’s brother held those proceeds on bare trust for the Husband and obtained a third party debt order against the brother’s bank account. Mr Justice Mostyn awarded the Wife indemnity costs and referred the file to the DPP for consideration of consequences for the Husband and the brother of their perjury.
