Holly, Re [2025] EWHC 465 (Fam)

Henry Lamb, instructed by Tony McGovern of Creighton & Partners, represented the young person, Holly, in these complex Deprivation of Liberty proceedings.  The High Court gave a public Judgment naming not only the Local Authority involved but also the Directors who had, in the words of Mr. Justice Keehan, ‘failed to provide this vulnerable young person with complex needs with the care, support and services which she so demonstrably required in her welfare best interests’.  The Judgment details the extensive steps which were taken, on Holly’s behalf and by the court, to try and obtain the support which Holly needed and the ‘truly extraordinary’  decision of the then Director of Children’s Services to cease a search for an appropriate placement for Holly, for over a year, without notifying Holly’s grandparents (who held parental responsibility for her), or subsequently, the guardian or the court,  which ‘demonstrated a complete lack of commitment by this local authority to providing for the needs of this vulnerable and complex young person’.  This case marks another important step in the promotion of transparency in the Family Courts and the accountability of those responsible for meeting the needs of some of the most vulnerable people in society.
