Janet Bazley KC and Lucy Sprinz appeared for the father (instructed by Blandy & Blandy) and Jessica Lee appeared for NYAS in this case, which concerned a father’s application for a child arrangements order after contact ceased, due to allegations of sexual abuse by the child of the family, then aged 11. The mother responded seeking a ‘no contact order’ and a s.91(14) order until the child was aged 16. By the time the fact-finding hearing took place, the child had not seen her father for over two years but had been receiving therapy, partly on the basis that she was the victim of child sexual abuse by him. The Honourable Mr Justice Poole sets out the legal principles which apply to fact-finding in private law proceedings and records his concern about the “profound consequences” for the child and family when such allegations are raised, whether or not they are true.
