Deirdre Fottrell QC, Thomas Wilson and Marlene Cayoun have all acted for the children, through their Children’s Guardian, in the ongoing proceedings between His Highness Sheikh Mohammed bin Rashid al Maktoum and Princess Haya bint Al Hussein. They were instructed by CAFCASS Legal.
The case has been heard by Sir Andrew McFarlane, President of the Family Division, and has involved complex issues relating to factual disputes, diplomatic immunity, and the status of assurances given to the English court by a foreign State.
The case also raised difficult issues in relation to transparency in family proceedings, with the Court of Appeal refusing His Highness Sheikh Mohammed’s appeal against the President’s decision to permit publication of his judgments and the substance of oral argument during court proceedings.
The Supreme Court has refused His Highness Sheikh Mohammed’s application for permission to appeal.
