Deirdre Fottrell QC and Tom Wilson appeared on behalf of the child in the case of In the Matter of the Human Fertilisation and Embryology Act 2008 (Case O) [2016] EWHC 2273 (Fam).
This was a case in which the President made a declaration of parentage in circumstances where a fertility clinic had made administrative errors in the taking and recording of consent to parenthood. Unlike similar cases, following notification of the clinic's error the parents applied for and were granted an adoption order in relation to the child. The President considered the High Court's wholly exceptional power under the inherent jurisdiction to revoke an adoption order and, in the unprecedented circumstances of this case, determined that it was appropriate to exercise it. The President also considered the consequent effect upon the child's birth certificate.
