Deirdre Fottrell QC and Tom Wilson appeared pro bono on behalf of the Applicant, instructed by Goodman Ray solicitors who also acted pro bono. Andrew Norton QC appeared on behalf of the Secretary of State for the Home Department. 

This was the first case in which the High Court has considered whether it has the power to make a 'return order' in relation to a child who has been granted refugee status in the UK. Hayden J considered a number of preliminary legal issues, and gave important guidance on the interplay between asylum and family law. Hayden J also gave guidance as to principles of disclosure of Asylum information into family proceedings.
