Judicial Review & Administrative Law

We provide specialist advocacy and advice on matters related to the judicial review and administrative elements of cases emanating from the Family Courts or the Court of Protection.

In particular, several members have specialist experience in:

  • Advising and representing institutions and individuals in connection with Inquiries established under the Inquiries Act 2005 where issues of historical or recent child protection failures are investigated;
  • Advising and representing local authorities in Judicial Review proceedings in relation to their obligations under the Children Act 1989 and associated regulations, for example in relation to the financial obligations to children leaving care;
  • Advising and representing local authorities, parents and children in relation to the implications of the Human Rights Act 1998 and awards of damages for breaches of rights;
  • Acting in cases in relation to children with disabilities leaving care but needing protection under the MCA 2005.

Members of chambers also act in regulatory work before the First Tier (Care Standards) Tribunal involving the regulation of persons working with children and vulnerable adults.
