X v Z (Parental Order Adult) [2022] EWFC 26

A significant decision concerning parental orders and the scope of section 54(3) HFEA 2008 has been handed down by Mrs Justice Theis . For the first time, the court made a parental order in respect of a person who is now an adult. The court undertook a detailed analysis of the case law, the Article 8 rights engaged and the serious and lifelong legal consequences for all concerned if the order was not made. There was an acknowledgment that there may well be other families in a similar situation who need to urgently consider their position and any consequences that may flow. Deirdre Fottrell QC acted for the applicants instructed by Russell Cooke LLP, and Sharon Segal acted pro bono for the young adult, instructed by Goodman Ray.
